1.1. "Penkle Analytics", "we", "our", "us" refers to the analytics service provided by Penkle Analytics.
1.2. "Client", "you", "your" refers to the user of Penkle Analytics services.
1.3. "Agreement" refers to the agreement between Penkle Analytics and the client to which these terms and conditions are applicable.
2.1. These Terms of Service apply to all services provided by Penkle Analytics unless explicitly deviated from in writing.
2.2. By using Penkle Analytics services, you agree to these Terms of Service. If you do not agree, do not use our services.
3.1. Our offers are valid for a specified period. We are not bound by the offer if there are obvious mistakes or errors.
3.2. An offer or quotation does not automatically apply to follow-up orders.
4.1. Rates are exclusive of VAT unless stated otherwise. Payment terms are stated in the offer.
4.2. The obligation to pay arises upon acceptance of the offer.
4.3. Invoices must be paid within the specified timeframe. Failure to do so may result in penalties and suspension of services.
5.1. You agree to provide all relevant information necessary for the execution of the agreement.
5.2. You are responsible for the accuracy and completeness of the information provided.
6.1. Penkle Analytics will perform services to the best of its ability but does not guarantee specific results.
6.2. You are responsible for implementing the necessary scripts and configurations.
7.1. Plans are purchased for a specified term and can be cancelled monthly after the initial term.
7.2. We reserve the right to adjust, expand, or change functionalities of our service without notice.
8.1. Neither party will be liable for failure to perform obligations due to circumstances beyond their control.
9.1. Penkle Analytics is not liable for damages unless caused intentionally or due to gross negligence.
9.2. Our liability is limited to the amount invoiced in the three months prior to the damage arising.
10.1. Intellectual property rights related to the services provided belong to Penkle Analytics.
10.2. You are not permitted to reproduce or make available our material without prior permission.
11.1. Both parties agree to maintain confidentiality of all confidential information obtained during the agreement.
11.2. Disputes will be settled in accordance with French law.
12.1. Complaints must be reported within 7 calendar days in writing and with reasons.
13.1. Disputes will be settled through mutual consultation before resorting to legal action.
